True to an extent. The 1st and 14th Amendments would require that the availability of a particular venue be determined without discrimination based on the content/substance of the speech. Simply saying “no, your speech is incendiary and dangerous and causes a public safety concern…NO PERMIT FOR YOU!” is problematic and I have concerns about it being defensible.
Rather than deny the permit, it’s likely better and more easily defended to tell them they have to pay for whatever public safety measures the city deems appropriate based on the anticipated public reaction to their speech. It could easily be cost prohibitive, but as long as that requirement is applicable to everyone equally, it would be perfectly legit. The fact that the MLK Elementary School Kindergarten class pays a lot less for security and public safety measures for their “Art Day in the Park” wouldn’t provide a basis for a discrimination suit.
What about “the last time you got a permit a woman was murdered by your supporter”.
