I wouldn’t be concerned too much about this. Given that the initiative is so patently “insane, offensive, and clearly unconstitutional” as someone above put it, I can’t see any reason why anyone would vote for it were it to actually make it to the ballot.
We’re all a nation of reasonable people, so it would probably garner one vote, tops. Right?
Here’s what I found:
Matt McLaughlin, 45, who listed his business address as 19744 Beach Blvd., No. 219 in the Newland Shopping Center in Huntington Beach, CA 92648, filed his notice in late February and it was marked as received on Feb. 26 by the Initiative Coordinator in the California Attorney General’s Office.
McLaughlin proposes to kill “sodomites” to prevent God’s “utter destruction” a la Sodom and Gomorrah.
Furthermore, McLaughlin taps into Russian and Ugandan lingo in seeking to ban “sodomistic propaganda” and would fine offenders $1 million per occurrence and/or up to 10 years in prison and/or banishment for life from California.

No surprise, he’s a whackjob X-tian extremist. I don’t see how this would ever get on the ballot, but very sad that such hateful individuals as McLaughlin live among us.

How about I send a ballot initiative to Harris saying it will be permissible for Californians to shoot people in the head if they propose ballot initiatives that will allow them to kill gays on sight? It will be called the ‘Good Riddance Act.’

It’s also one of the biggest Republican strongholds in CA - and probably even the West Coast. Look at any California electoral results map and as a county it’s a small island of red surrounded by an ocean of blue. Plastic surgery, BMWs, Ayn Rand cultists and racism are its defining characteristics once you can look past Disneyland.

But that’s really beside the point. It’s like saying, Anyone can file a lawsuit alleging whatever lie they want. Merely exercising the franchise of citizenship that allows you to file a lawsuit doesn’t mean you’ve won anything at all.

So, what happens is that the AG or someone else with standing refers this to the California SC and phfffft goes the horrible question, never to be put on any ballot.
Someone - Brendan - should put a call into the office of the California state AG that handles ballot initiatives and ask about all the truly nutbar racist porno crazy fruitbat ballot proposals that never made it onto a ballot given the voting public.

(Now some legalistic mind can make the argument that his actions are not unethical just immoral. That line may be quite narrow, but in any case, his ‘proposal’ should not go unchallenged ASAP.)
