I would agree but for the fact that Prop 215 allowed California to be the first state where medical marijuana is legal. If it weren’t for that ballot initiative, I doubt that we would be having any discussion of the efficacy of medical marijuana. California paved the way for the rest of the nation, and history is in the making as a result.
That being said, it should be clear that when a ballot initiative is clearly designed to take away people’s civil rights, a line has been crossed and that should not go on the ballot.
If the Court doesn’t favorably rule on Ms. Harris’s petition, then she should just go ahead and make it clear that anyone who signs the petition is on record of conspiring to commit murder and have them immediately arrested and arraigned.

Sales taxes still will apply on anything they purchase through the commissary. No smokes, as it is proven to be detrimental to one’s health – no way do I want them developing emphysema or lung cancer on the people’s watch. The people who solicit signatures know very little about the issue, just a brief outline of what it’s about and mostly described by the organization supporting the issue. To ask them to elaborate is a waste of time, so I feel unless it’s going to deprive civil rights, incite murder such as this thing, or something else so awful I recognize it right away, I’ll sign and let others decide if it’s worth passing at election time. I’d remind you that Proposition 13 also originated as a ballot initiative.

I am not a lawyer but I imagine many commenters here are so I ask them: Could a case be made that this proposal is an incitement to murder? At the very least, I know that there are certain moral and ethical requirements for possessing a license to practice law (my son and daughter-in-law are both lawyers) , and it would seem possible (to me at least) that this sort of thing would fail those requirements. Is it possible to initiate a Bar inquiry?
The people who solicit usually get paid $1.00 for each signature, so they sometimes sound like carnival barkers as they stand in front a supermarket or Starbucks or someplace else with a lot of foot traffic. And no, they don’t care about the issue or even understand it. They tend to robotically repeat what they’ve been taught. As to the buck payment, the price went up to $5.00 for the recent ballot initiative which deservedly failed which had to do with making California into six separate states. It couldn’t get the required number of signatures whatever it was at the time so it didn’t make it onto the ballot.
Why doesn’t she just refuse to put it on the ballot, let some asshole petition for writ of mandate, and then move to dismiss. Grounds for dismissal could be lack of justiciability and fulfilling the duty to put the measure on the ballot would conflict with stronger duties not to violate the constitution.
If reprehensible were enough, this would be over with. I don’t believe that this is even a serious proposal. Just the fact that it has received this much attention is more than this wacko could’ve ever dreamed of.
If I were a California native I would quickly file for a proposal called “Sodomize Matthew Gregory McLaughlin Act” that allows anyone to sodomize Matthew Gregory McLaughlin at any time for being a despicable human being.
