Having 8 Justices for 1.5 years is about the smallest way SCOTUS is institutionally dysfunctional. It shouldn’t be possible for corporations to fund think tanks, to hire lawyers, to read judicial activists’ smoke signals, to recruit plaintiffs, to shop the best venue, to file the most meticulously orchestrated lawsuit possible, to win 5 votes, to overturn whichever precedent is deemed necessary, to allow the corporations at the beginning to do whatever they want.

The process is upside down from start to finish, and let’s be honest about Scalia for a minute. One could only speculate which overturnable precedent he was telegraphing at the cocktail reception at the “hunting” resort the night before he died. Even the “hunting” is backwards, for crying out loud, they’re taking pot shots at birds raised in captivity to become some rich guy’s target!

Scalia’s timely death monkey wrenches about 5 years worth of upside down, which was to come to a head this term.

We may not NEED an “institutionally dysfunctional” SCOTUS, but it’s precisely what the GOP/Teatrolls want, and they see this as their opportunity to get it. They’ve already broken Congress in their quest to prove that gov’t is broken and now they have a chance to break the 2nd of 3 branches. At that point, they’ve pretty much won the Civil War. I mean, we all know they’re still fighting it…and we all know it was always going to be an inside job.

Ugh. I love Vice President Biden and I really wish the stars had aligned to allow him a real shot at the presidency, but this is not what we need – wishy washy “institutionally dysfunctional” talk. It’s true, of course, but it’s not terribly strong. I was glad to see both Sec. Clinton and Sen. Sanders come out hard yesterday with a strong message, and the Vice President needs to be much stronger than this. Hammer home the message:

The U.S. Constitution says a presidential term is 4 years.
The U.S. Constitution says President Obama is obligated to name a new S.C. justice.
The U.S. Constitution says Congress is obligated to review the justice and vote on her.

Repeat, repeat, repeat.

Yeah…that’s the kind of hat trick America may never come back from.

Certain “think tanks” and “study foundations” (really 501c4 donors) have thrown down the gauntlet to GOP Senators, hoping that their dark money will propel their chosen candidate, eligible or not, into POTUS position and they can continue to expand their control over the government.
BTW, this is no longer a government but a theater company - pledged to make the incumbent a “one-term president” (McConnell, Cruz) and prone to temper-tantrum shutdowns of government processes and services in aid of their hissy-fits. How are we supposed to respect these (vulgarity)? Do NOT respect - do NOT reelect - and DO YOUR JOB AS VOTERS – Vote for people who deserve to serve and if you can’t find any, run yourself!!
