You’ve put your finger on the problem. It’s one thing for a court to order an agency to leave a rule in place. It’s quite another for a court to wade in and tell the agency exactly how it should be enforcing a rule. An agency can slow-walk this stuff forever.

So even if the new head of the EPA wants to redirect the EPA’s mission away from, you know, environmental protection, he may not legally be able to. I’m all for that. Who in their right mind WOULDN’T get behind the EPA enforcing environmental protection laws? We’ve got to live here. Companies who don’t produce their products without sharing their shit aren’t paying their full cost of production. TANSTAAFL.
