A fix is required because a potential majority on the SCT could follow the axiom that where the statutory language is clear, that’s the end of it and its up to Congress to fix it. The problem with this statutory issue is that it fits perfectly with the view that you don’t look at Congressional intent because Congress is presumed to enact what it means to enact. That’s why it’s such a serious problem.

The notion that “Kennedy could go either way” is absurd. Kennedy has been nothing short of hostile to every tenet of the ACA.

This is pure nasty politics, designed to hurt as many of he 20 million people who have been added to the insurance rolls as possible.

If the law is established to subsidize people in the states that set up their own exchanges and the law permits the federal government to provide an exchange if the state does not, then where in the law does it say that the federal substitute exchange must be a crippled copy?

What will this do to Democratic turnout in November? Democrats for health care with a working program, Republicans out to kill sick people to take Obama down? Sounds like a Democratic platform for retaking the House to me.

What’s inconceivable is that Kennedy would vote for anything that would benefit the ACA. Why do people keep acting like he is a swing vote? Are you stuck in the 1990s? Sheez.
