And given Trump’s comments, particularly, “I think we ought to go back to the first one,” he’s just given the courts ample ammunition to block the travel ban permanently. No discipline, no self-control, and no filter on his mouth. I guess I should be grateful for that, given that it hurts him and that it helps to block bad orders like this but, oh my god, I’m so tired of wondering just what this narcissistic child will do next.
Over a half-dozen federal judges knocked down Travel Ban 1.0. Let’s hope Travel Ban 2.0 can beat that record, preferably by doubling it.

In this episode Tracey Tong, 23, of Queens, an American of Chinese-Peruvian descent defends an "Indian-Muslim" couple who were being verbally harassed by a passenger aboard a crowded New York City subway train.
“In Spanish, in English, in Chinese, in French, whatever language you want me to tell you. I will tell you whether you are from here, Puerto Rico or wherever you are from. I am born here and I don’t like the way you are treating her,” Tong tells the woman. “We are all in this together. Whether you like what’s going on in the government or not, fuck it, you got to deal with it. You are a grown woman.”

Wow. The woman attacking the couple was from Puerto Rico, with a heavy accent, so probably fairly recent to the U.S. And she is asking the Indian/Muslim couple “Why are you here?”
Love Ms. Tong. She exhibited more patience and diplomacy than I could have mustered. Though when she launched into Spanish, her passion really came through. You go, girl!

I’m concerned the First Amendment argument is the weakest because of the pains they have taken in the actual text to appear religous neutral. Yes, there’s good case law that says that the courts can look beyond the words, but as a lawyer of nearly 30 years, I can tell you courts almost never do, and this is doubly true for conservative courts.
The better arguments in my seriously humble opinion (I’m not an immigration expert) are based upon no actual evidence of an emergency involving the affected countries and the discrimination based upon national origin that Congress has expressly forbid. Probably also upsetting the quotas established by Congress.
Also, for those who haven’t figured it out yet, this order is not temporary. Once it is in place, they will renew it over and over again in 90 day or 6 month increments and slowly add Muslim majority countries. But it will also always be political. For instance, Saudi Arabia will never be on the list even though 16 of the nineteen hijackers were Saudi and Saudi is leads the world in the export of radical Islam.
