The key point which Scalia et al willfully ignores is that all exchanges are 42 U. S. C. §18031 exchanges. The actual language is that states have to establish exchanges under 42 U. S. C. §18031, which spells out what those exchanges have to do.
If a state fail to establish a §18031 exchange, then 42 U. S. C. §18041 tells the Feds (specifically the Secretary of Health and Human Services) to set up “such exchange” (i.e. a §18031 exchange) for them.
So it really doesn’t matter if the DHS or a State agency set up a states exchange.
Either way, they are 42 U. S. C. §18031 exchanges.

And the road to basically single-payer is actually built within the ACA framework and would get us there through people voting with their money if/when a public option is simply opened up within the ACA exchanges.

Pardon me for posting this comment here, but since Josh Marshall doesn’t allow comments on his blog, I don’t know where else to put this.
Josh begins his blog post on “The Mick Jagger Reality of Justice John Roberts” with these incredibly stupid words: “With the apparent demise of the Confederate flag, the vindication of Obamacare and chronic poor diet, these really are the days that try the elasticity of the arteries of post-55 white male America.” Are you fucking kidding me, Josh? You really want to insult all white men over the age of 55? Would you ever dare write such a generalization about blacks, or Jews, or Muslims, or women? If not, what the fuck gives you the idea that it’s okay to write such horseshit about older white men?
For the record, Josh, you stupid fuck, I am an over-55 white male (I’m 64, to be more precise), and I loathe the Confederate flag, wish Obamacare went further, and enjoy a pretty healthy diet. Also, Josh, I was a good old-fashioned liberal before you were even born.

Which, I think, highlights why conservatives went ape-shit over the ruling: in some aspects of his opinion, Roberts did a better job advocating for the law than many of the democrats have. I mean, much of the text deconstructed all of the bogus arguments that conservatives trot out in their attempts to talk about how “horrendous” and “catastrophic” the law is or has been.
Hearing him talk about the cohesive nature of the tenets of the law, and what it intended to do probably pissed them off as much as the fact he upheld it to begin with.

Wow, sane and reasonable argument. Just wow–should not be “wow” at all, but coming from this “Hobby Lobby” court, it represents a return to reason (however brief). It blows my mind how the democratic process has become “unconstitutional” to the extreme right. We elected a president and with an elected Congress, a law was passed and signed. Doesn’t get more democratic than that. It’s laughable that the GOP is now saying things like “Well, our last resort is to elect a Republican president.” Yeah, you shoulda been focused on that all along. Delegitimizing every single thing our black Dem Prez may play with your paranoid under-informed constituents, but it flies in the face of democracy. Using the courts for this refusal to accept democracy is also inappropriate. Glad you guys lost. You deserved to.

This serious failure of conservative legal strategy and constitutional values is more evidence of the orange drunk John Boehner and spineless turtle Mitch McConnell’s incompetence and ineptitude.
I also am not sure that conservative billionaires invested enough of their money into this cause. If they had, they would have won the case.
I took a double-take as well. Didn’t laugh. And I’m a 58-year old Black woman.

There’s something really bothersome about this analysis - the Supreme Court is supposed to judge the law, not the politics. It is highly unfortunate that this court seems to have set itself up as the ultimate political authority instead of judging the law.
As it turned out it was very much worth the time and effort… Tbaggrs paid for supreme court protection of the subsidies

Try to calm down and remember this is a community of like minded people who aren’t perfect but try to help each other to understand and sometimes laugh at what is happening in the world.

I just want to add that Scalia certainly knows his “applesauce”. Let’s hope they’ll be serving it to him soon through a straw, strained and pureed, in some gated retirement community when he finally throws in towel and leaves the court for good. I can dream, can’t I?
