Can some of our esteemed barristers weigh in here? Can this be considered age discrimination? I’d like to think it’s a bunch of BS, but my L&O degree only goes so far.
You know even if you win Walmart and Dick’s could just decide to stop selling guns all together right numb nuts? For Dick’s all hunting related sales (not just firearms) make up only 10% of its total sales.
Watson claimed that he attempted to purchase a .22 caliber Ruger rifle from Dick’s on Feb. 24 and then tried to buy a gun from Walmart on March 3. According to the lawsuit, both retailers refused to sell Watson a firearm because of his age. Oregon state law allows anybody to purchase rifles or shotguns starting at the age of 18, but federal law requires a person to be 21 in order to purchase a handgun, though that restriction does not extend to shotguns or rifles.
I’m going to regret saying this, but I hate the 10th amendment.

There is no law against discriminating against people under 21 on account of age, dipshit.
Unless this is some kind of Oregon thing, of course.
Edit: and, looks like the Oregon legislature, in it’s wisdom, inadvertantly made it illegal to not sell assault rifles to people under 21.
Pretty safe bet that Walmart’s office of counsel is confident that the answer is no.
Here is a fun idea: Maybe the corporations should cite their deeply held religious belief that anyone under 21 should not be allowed to own a rifle.
Excellent point. Walmart’s legal counsel may be large enough to occupy a small town, I would guess.
I’m going with their store their rules. And it is not like he is being denied a job because of his age or being fired because of his age.
Refuse to sell a wedding cake to a gay couple and cite religious freedom. Perhaps Walmart should cite religious freedom in refusing to sell guns to anyone under 21?

I disagree with just about everything Wal-mart tries to get away with but if their lawyer takes this tack, they all getting all of my sporting goods business, Dick’s too.
