What situations can you imagine where there would be a 4-4 deadlock on something election related with the current makeup of the court? You’d need one of Roberts or Gorsuch or Kavanaugh to switch sides without anyone else coming along.

Roberts likes to appear reasonable while poisoning the well, that is his schtick. Robert’s could be the tie vote.

It seems like first big, and very critical ethical test of ACB is whether she accepts the nomination under these circumstances. If she does, she fails the first test. If she doesn’t recuse on all matters relating to the election, she will have failed the second ethical test. Assuming she lets her ambition rule, can we really expect to see fair, non-[partisan rulinlgs? Of course not.
