I don’t think it’s a good idea to leave out the legal jeopardy Trump is in from state prosecutions, because that is the threat to him that will push him to extremes. Nothing he could do if elected to stop the ongoing federal prosecutions, or prevent future federal prosecutions, would do him any good at all if he still winds up in some state prison after he leaves office. The Georgia RICO case already under way seems likely to end with a conviction, and it seems almost assured that if he takes any of the measures discussed here to evade federal legal accountability, that fact will guarantee that more state prosecutions would be forthcoming.
Trump has to win a second term to avoid going to jail in 2025, He also has to stay in office forever to avoid going to jail after his second term is up in 2029. This need to stay out of prison will drive him first to get a second term by any means necessary, and then to never leave the WH once he gets there. Even if he actually wins the upcoming election and so doesn’t have to commit any fresh crimes to get back in the WH, he very clearly cannot stay president forever without overturning a whole lot more of our constitutional order than mere prosecutorial independence.
Barriers to the breach prosecutorial independence will therefore not deter Trump even a little bit from that end. He was deterred from making Clark the acting AG by the threat of mass DoJ resignations because at that time that action would have completely closed off his last remaining hope, that the R majority Senate would block the certification of enough EV tallies to deny Biden the presidency, if only for the 10-day delay to allow the “forensic audit” and “definitive recount” to serve as cover for a push to settle the dispute by contingent election.
Well, at the onset of his second administration, nothing would fit his plans better than a mass resignation of everyone at DoJ with any devotion to the ideal of prosecutorial independence. He needs to fill the DoJ with thugs who will do his bidding no matter what, and the resignation of people loyal to the US rather than to Trump is exactly what he needs, both to make more room for his people, and to remove well beforehand any who might try to block his staying in office forever when that crisis arises in 2028.
Is he dumb enough to think he has a future after Trump 2.0? It’s Ivanka 2028 unless it’s Trump 3.0.
Or the Joint Chiefs, after staging their coup, could order a new election for a president who’d hold office until January 2029. And while their doing this extra-constitutional maneuver, they could also order that the election be by popular vote, bypassing the electoral college.
Maybe not so sad.
In short, post-Reconstruction courts have rarely upheld or applied in full the ambitious demands of the 14th Amendment. Instead, its guarantees have been watered down to accommodate the political forces of the day, or repurposed to serve powerful interests (such as the dubious determination that corporations are “persons” entitled to its protections), or treated like an a la carte menu, in which some items — such as the guarantee of privileges and immunities and all of Section 2 (which would reduce state representation as punishment for voter suppression) — are essentially ignored.

With the Roberts’ Court gutting the VRA left and right, why aren’t we bringing challenges based on Section 2 to reduce the number of House Representatives of state’s that engage in disenfranchisement?
If section 2 were brought to bear against states that are currently practising disenfranchisement, which we know some very good examples of,(FL, LA,and so on…) if those states are also egregiously gerrymandered, think of the result. i fear that only Dem reps would be lost.

Lest we forget the 26th Amendment that gave 18 year olds the right to vote. The 14th, section 2 was specific in that it mentions males aged 21 years. It does not mention women who at the time the 14th was adopted could not vote which was changed with the adoption of the 19th Amendment. The two (19th and 26th) taken together ought to result in an increased number of voters… assuming folk choose to vote.

At the end of his last term, he declined to preempt any prosecutions of himself or his coterie by issuing blanket pardons for Jan. 6 and the events leading up to it.
That’s because there were people in place who would thwart that, just like his idea of making Jeffrey Clark the AG. Remember also that after Jan 6, his political support went down the toilet for a couple of months, so no one would have backed him up on that untested idea at the time.
