A federal judge in Nashville has dismissed the criminal case against Kilmar Abrego Garcia, ruling that he was the victim of vindictive prosecution by the Trump Justice Department.

He’s entitled to the whole thing! Sent to a concentration camp in another country to be beaten and abused, then returned here to be abused, all while the entire administration is calling him a criminal, but refusing to give him due process

Maybe most of it, but remember there are plenty of other people who’ve been prosecuted, charged, or otherwise harassed by this Administration for political reasons, and they should get a share too, even if their ordeals have not been as long or harrowing as what Abrego Garcia has been through.

I have gay and trans friends who’ve moved to or taken jobs in European countries just so they can feel safe, even though nothing bad has happened to them yet. So if Abrego Garcia decides to seek refuge in Costa Rica, I say: after all he’s been through, we should honor and respect whatever choice he makes.

This administration isn’t vulnerable to shame or bad p/r. They want to be cruel and they want to seen doing so.

It’s not like they wrote in the judgement something like

“FOREVER BARRED and PRECLUDED”

statement that was in the First Felon’s IRS order.

Not legitimately but I’m sure they’ve already got something planned. Probably arrest him for the crime of embarrassing TSF if he tries to fly to Costa Rica.

Absolutely. I don’t know the man at all, if he thinks Costa Rica is better living than the US of A, go for it. It’s unfortunate those traitors forced it on him, I wish we could return the favor to everyone who willingly works for trump et al, you know, send them to Afghanistan with anti taliban documentation and let 'em go!

It is an interesting coincidence that two cases of real lawfare, this case and the Broadview 6 case, were decided against the Regime at the same time that the Regime is muddying the meaning of lawfare with its Sedition Slush Fund.

So, I assume that the dismissal of his case is “with prejudice.” The judges order doesn’t explicitly say so, nor does the article.

If a defendant wins on a claim of vindictive prosecution, is the dismissal automatically with prejudice?

Agreed. I was comparing Trump’s J6ers to Abrego Garcia. They were given the due process. Some of them have gotten out of prison/been pardoned and committed MORE crimes. Here is Garcia being smeared all over media, but the administration never considered putting him on trial for anything- they just wanted to deport him to a prison elsewhere to be tortured.

There are plenty of people that have been victims of this administration. They got no due process and had to suffer because they got on Trump’s bad side. Jim Acosta is thinking about filing because his press pass was pulled. James Comey could definitely file.
