Biden Planning To Act Quickly To Protect And Advance LGBTQ Rights | Talking Points Memo

As vice president in 2012, Joe Biden endeared himself to many LGBTQ Americans by endorsing same-sex marriage even before his boss, President Barack Obama.

This is the only morally correct action to take.

EO’s can be overturned with EO’s so this should be fine within the first few days of the administration. Even if it wasn’t via an EO, it could probably be challenged using this instrument.

In the meantime, have ya’ll seen this nonsense:

Kayleigh McEnany on Trump’s election legal battle: Judge ‘misunderstood’ argument - AmpGoo Entertainment and news from the worlds!

There is no print on this yet, but honestly they think they are smarter than the judges that are on the bench?

This from people who use conspiracy theory and feelings to justify their 36 lawsuits, which have almost all been thrown out because of no actual evidence?

Good Lord…

As this is an AP piece, I will hold my criticism of the tone.

Expanding the law is important, however so is using what the current law is. Time to enforce the civil rights act to go after the haters.

As for “religious freedom?” You are free to hate. If you discriminate, that’s fine too. But remember, Caesar’s face is on the coin, and Caesar has the right to rule how you use that coin. And also remember, Jesus never discriminated in the myths.

“Anti-equality forces are trying to use the framework of religious liberty to strip away individual rights,”

The Barrett Court has already voiced its position on this issue. Any governmental action or legislation that does not comport with their fundamentalist beliefs is an egregious frontal assault on the 1st Amendment’s unqualified, absolute protection of their freedom to practice their religion.

There should be an asterisk attached to the legislation that the protections do not apply to Richard Grenell.

And to heck with the safety and rights of the rest of us.

This is an area where Biden will strongly lead the nation, and after four years people will realize that trans people aren’t any different from the rest of us. It’s the same path that LGB had to take, and things will move more slowly as there are far less T people out there, but advocacy will help a lot.

We’re going to have a confrontation in the near future about all of this “religious freedom” nonsense…the same arguments being made to restrict the rights of LGBT people in the name of religion are easily expandable to anything else. Interracial marriage, other religions, there’s no limit to what the religious bigots would want to restrict, and they are already using this argument to remove rights from women. At some point, the people just have to decide that it’s not fair for us to follow the tenets of one religion…I’m really looking forward to the challenge when other religions start fighting back, and when we have a Supreme Court that will pay attention to what the 1st Amendment says about this, instead of the current Republican Supreme Court that is twisting the words to their own ends (that aren’t “originalist” in any way).

I believe the rationale when “religious freedom” was used as a defense for racism, the Courts said a public business is required to follow all civil law as part of the cost of doing business in a public market.

Yes. Yes, they do.

This is why I said, on Twitter, that Giuliani thinks he’s John Cage when he’s actually Richard Fish.

(For the young crowd: It’s a reference to the old ALLY MCBEAL tv series from the late 1990s, set in the Cage&Fish law firm. John Cage, portrayed by Peter McNicohl, was the brilliant but [very] eccentric lawyer who was a terror in the courtroom. Richard Fish, played by Greg Germann, was the co-head of the firm, and as incompetent in the courtroom as John Cage was great; it eventually was revealed he got his law license by cheating on the bar exam. And yeah, on one of the rare occasions he was foolish enough to actually argue a case, his argument was “The Supreme Court was wrong, Your Honor! Just plain wrong!”)

Have to wonder about the success of the real world against the lack of reality on the Christian Taliban SCOTUS justices, now. I don’t think that discussion is going to go well at all. After all, the ‘originalist’ perception of the Constitution really didn’t recognize anyone but white landowners, ignoring women and people of color for over a hundred years. The ‘originalists’ will simply argue that there is no provision for LGBTQ+ people and will try to further make women and POC second class citizens, adhering to the ‘originalist’ position.

It still doesn’t explain how Barrett is even on the court, since she’s a second class citizen too, right?

Sorry to play Debbie Downer, but whatever LBGTQ policies come from Biden or the House will die in the Senate or the Supreme Court. A clear majority of the Court will end gay marriage at the first opportunity and reaffirm the “religious right” trump (pardon the pun) any other civil rights. The theocracy has arrived.

For those following along, the farm has been very busy the last day and a half with a raft of online sales and promotionals that began at midnight on the 27th and continue through Monday night.

They worked their butts off all day yesterday, along with a coterie of friends that are always on hand for labor.

Son in law demonstrates this morning what level of effort was required yesterday, from which he is still recovering:

It’s very difficult for a judge who lives in the real world to understand the voices of The Crazy that echo around inside Rudy and the other Trumpsters’ heads.

Someone said in the last couple of days that the delusion that Trump will be inaugurated is on par with the delusion that Bigfoot exists.

I like it.

Anytime I see some nincompoop on FB claim that the election was stolen and Trump is the rightful President and all will be made clear, I ask them when’s their next excursion to find Bigfoot.

Smart and simple. What is nice about this approach is that it ties in with other themes. For example, we can expect Kerry to bring up environmental racism or Harris pointing out environmental sexism.

We have several national holidays named after men, but not many for women. America should finally have a Rachel Carson Day, for example. It’s not like Congress hasn’t been to this well before.

Democratic Senator Benjamin L. Cardin of Maryland had intended to submit a resolution celebrating Carson for her “legacy of scientific rigor coupled with poetic sensibility” on the 100th anniversary of her birth. The resolution was blocked by Republican Senator Tom Coburn of Oklahoma,[121] who said that “The junk science and stigma surrounding DDT—the cheapest and most effective insecticide on the planet—have finally been jettisoned.”

There’s actually some physical evidence that a large hominid cryptid specie may exist. That’s in direct contrast to the total lack of evidence of significant voter fraud.

And, just to bring it back on point, I bet Bigfoot supports LGBTQ rights.

These aren’t even the tenets of one religion, they’re the tenets of certain sects of Christianity. But there are a whole lot of Christian churches that don’t believe a word of this nonsense, that are as far apart from the ACB version of Christianity as two different faiths altogether.

Or Thomas.
