Democratic presidential candidate Joe Biden signaled on Thursday night that he was open to adding seats to the Supreme Court depending on how the Senate GOP’s rushed confirmation process of SCOTUS nominee Amy Coney Barrett plays out.
Biden told Stephanopoulos that his position “depends” on how the process is “handled” by Senate Republicans as they aim to ram through Barrett’s confirmation before the election on November 3.
Sorry, yes I am voting for him, but What the Fuck does Barrett’s confirmation have to do with this, you would think that Gorsuch, and Kavanaugh had already shown the GOP’s intentions
He simply does not want it to be the issue, he, and we, all know the outcome. Give it to the Press and it will be all we hear about for the next 3 weeks.
"It depends on how much they rush this,” he said, also jabbing at GOP senators for fixating on filling late Supreme Court Justice Ruth Bader Ginsburg’s seat instead of working on COVID-19 relief.
“If they vote on it before the election, you are open to expanding the court?” Stephanopoulos asked.
“I’m open to considering what happens from that point on,” the Democratic candidate replied.
As others have noted, this is precisely what he should say. I expect after confirmation a patented Joe Biden 1,000 watt smile when he lets everyone know that his thinking has evolved on the question and is now making a list.
And there are a couple of Affordable Care Act cases coming up soon. Biden can also say he’ll take what happens there into consideration as well.
He needn’t fully commit.
But keeping healthcare prominent in people’s minds has a way of helping people focus on what’s really at stake, with the court and with the next election.
Constituents should demand Feinstein’s resignation. Even if these dinosaurs can function, their questions and comportment do not have the passion and outrage necessary for a sham hearing like the one we just witnessed.
While I’d be thrilled to see Joe say he’s adding justices, he doesn’t owe anyone any answers here. Trump won’t answer a direct question on what time it is.
I would perhaps refer to “court reform” as in "there are numerous ideas for reforming our court system.’ And if Congress decides to explore those options he should promise to keep an open mind and do what is best for the country.
I saw this. Biden played it perfectly. Hey Republicans if you insist on going forward with Barret, I reserve our right to expand the court to reduce her influence on a range of issues.
What people don’t understand is that we already have a court committed to making it easier for the oligarchs in the upper 1/10th of one percent to separate the rest of us from our money, freedom and future. Barrett might move the needle a little on issues important to evangelicals. In fact they won’t repeal Roe because doing something to unbalance the fine relationship Republicans have with evangelicals and Catholics would threaten the control of oligarchs. Gorsuch or Kavanaugh will have a conversion and become a moderate disappointment to the Republican chattering class. Balances have to be maintained.
She hugged Lindsay and told him it was one of the best hearings she’d ever exprienced. Graham’s numbers went up by at least 6 points. After all, it was such a lovefest.
Every election counts . She could have just preserved the Senate for the GOP. It’s inexcusable and unforgivable.

Biden’s approach is clever. He’s letting Moscow Mitch and Miss Lindsey know he will support court reform if they confirm Amy Covid Barrett. It’s a way to blame the Trump/McConnell GOP — as he should.
This also opens the door to Schumer eliminating the legislative filibuster, since that is needed to pass any judicial reform bill. This, in turn, will not only defang Moscow Mitch, but ensure a Biden presidency is productive.
