I have many extended family members who were consumed by the Shoah, which – in a very real sense – was the ultimate expression of allowing the state to murder its own citizens (although Stalin, Mao, and others certainly earned participation trophies).
That, perhaps, is the basis for my absolute opposition to state-sanctioned murder, because once you allow legislators to legalize murder – even for those convicted of unforgivable crimes – there theoretically is no end to where it goes.
Executing drug dealers? Executing sex offenders? Executing child-porn possessors? The slippery slope is way too easy for populist politicians and rightwing “law and order”, “tough on crime” demagogues not to take.
(Frankly, I’ll be surprised if we don’t hear attention-whore Republicans trying to “out-Trump Trump” by demanding the death penalty for abortion-care providers, teachers who “expose” students to banned books, or even “three-strikes-and-you’re-out” repeat offenders.)
IMNSHO, the only choice for any society that hasn’t completely lost its mind is an absolute prohibition – on principle – against state-sanctioned murder in any form.
(And that doesn’t even address the very real and ubiquitous problems of racial inequality, courtroom incompetence, and prosecutorial corruption that continually expose the breathtaking injustice of applying the death penalty in real life.)

If Biden could not “in good conscience stand back and let a new administration resume executions” that he halted, then why did he leave three to be executed by Trump? If the death penalty is wrong, then it is wrong for all—even the most heinous offenders. Having stood before juries and argued for the lives of capital defendants, I can attest that our system of capital punishment is embedded in racism, deeply unjust, and a shameful stain on our national character. People sentenced to life without parole will die in prison and that should be more than enough to saitisfy those who desire retribution.
