An Obscure 1800s Law Is Shaping Up To Be The Center Of The Next Abortion Battle

Goodbye, First Amendment.

Why stop with Anthony Comstock? Let’s go back to Augustine.
Promise, these whackadoodles won’t stop with abortion.
They want to outlaw contraception.

Yes, they love their freedom so much, they want control over the disposition of our bodies. (ed.)
Maybe even a little prima nocta, ya know.

What makes you think that?

. . . in future cases, we should reconsider all of this Court’s substantive due process precedents, including Griswold , Lawrence , and Obergefell . Because any substantive due process decision is “demonstrably erroneous,” Ramos v. Louisiana , 590 U. S. ___, ___ (2020) (Thomas, J., concurring in judgment) (slip op., at 7), we have a duty to “correct the error” established in those precedents,

Justice Thomas’s concurring opinion in Dobbs.

Alito and Thomas aim to move Margaret Atwood from the “Fiction” aisle over to “Non-Fiction”.

And then to eliminate both aisles, in favor of “Hitler Biography” and “Christian Lifestyle”.

It’s funny how much energy these people can expend on fetuses because they’re supposedly “pro-life”, but can muster nothing more than thoughts and prayers as Americans fall victim to mass murder almost every day across America.

It’s rather a major reason why I don’t take their alleged love for the sanctity of human life seriously.

The doublethink is doing some heavy lifting there.

This TPM illustration shows Comstock was regarded as a bit – dare we say – fringe, even in his day.

We have or had laws in cities prohibiting the display of undressed mannequins.
In my lifetime, condoms and foam contraception were under the counter. Could not display. Comstock legacy.

Alito is going to have trouble showing that porn “is not deeply rooted in the Nation’s history and tradition,” and he’ll have to go much further back in time than Henry de Bracton’s 13th-century treatise to find support. The Turin Erotic Papyrus (Circa 1150 B.C.E.) depicts 12 sexual positions that “fall somewhere between impressively acrobatic and unnervingly ambitious,” one even involving a chariot. *

The business of America is business (think it was Pres Truman). You put up roadblocks to commerce and Corporate America will scream. Thank God I just got my new blowup doll. Don’t know what to do with Candy, worse for the wear after all these years. But we had a connection.

Not to mention hungry kids and adults. In the 90s I subbed in elementary schools in Calif that provided a slice of bread and peanut butter to kids arriving for school. They had learned that some number of kids did not have food for breakfast.

New team coworkers from Europe (when I was working) would ask me about America. I use to tell them they had to live here a few years to understand “things”. A simple easy answer. Now I don’t even have an answer myself. So many cross currents it makes it impossible to keep up with. But that’s what the puppeteers want. But that’s another story - to be played out in the next year or so.
