I think you miss read Garland. I think he’s trying to balance things out at the DOJ post TFG. I wouldn’t jump to any conclusions.
Barbara McQuade just made the point on MSNBC that you don’t appoint a Special Counsel - especially someone like Jack Smith - if you’re just going to walk away from indictments. Short delay, but indictments more likely sooner rather than later, with bigger impact than if DOJ acted on its own.

Why? There is no conflict of interest. The election is 2 years off. There are no extraordinary circumstances, except that it is Trump. Everyone else in similar circumstances have been charged and jailed.
Do you really think Barr would have blinked, and appointed someone? Nope, he would charge them.
Lastly, the GOP will try and shred the SC and Garland no matter what. So the hope this insulates them from attack is delusional.
