I find it fascinating that all the RW asshats I see crapping on about Smartmatic and Dominion never bother to mention the IP that Dominion acquired in 2010.

It is high time these sycophants are held liable for jumping on the Trump train. While Fat Donny (and getting larger!) is immune for now, they are not.

These video disclaimers are not going to keep them out of the courthouse. Too little, too late.

Next up should be to sue the Fox, Newsmax and OAN reporters/anchors for defamation. They will claim First Amendment, so it might be a real struggle, but it is time to deplete their bank accounts with legal fees.

One of the things I like about TPM comments is the generally erudite use of language and higher level thinking. I’m pretty sure that one can make an emphatic point without the use of the sexually charged **** three times in two sentences.

I would have though that Smartmatic and Dominion have a huge case, and the damage is real too. I don’t see a single US election official buying their wares in the future, it would just be to controversial. They will need to found another company and re-write the software from the ground up, without any references to the current versions.

Hasn’t Fox screwed themselves claiming they’re not a news service but an opinion outlet. If they were just reporting on the content of the lawsuits they’re probably safe. But by broadcasting opinion pieces alleging fraud they presumably are guilty.

Smartmatic sent a lengthy legal notice to Fox News demanding a public retractions “on multiple occasions … and across the various platforms used by Fox News to disseminate the false and defamatory statements.”

So, Smartmatic implemented their own Fairness Doctrine.

Isn’t it nice of Timmerman, Jerry Rosen, et al to continue providing evidence of the effectiveness of the smears against Smartmatic and Dominion? Hopefully, these companies will argue that -

  • a few airings of the facts don’t outweigh the amount of lies aired by Dobbs and the others
  • they won’t be satisfied that Fox has corrected the problem until they start to see a significant number of the wingnuts acknowledge the corrections

The standard for a defamation law suite over a matter of public concern is “malice”. That is the plaintiff would need to prove by preponderance of the evidence (50% + 1) that the defendant knowingly and purposefully caused injury by evil intent.

It is a very hard standard to prove against an individual broadcaster especially when giving an “opinion”.
