Seems to me that the appropriate response by Democrats after the inauguration will be to ensure a 7-- 6 Moderate Court.

Seems to me that Congress will need to do its job better, writing their legislation better so that there is not a lot of scope for regulatory (mis)interpretation, and for the courts to play around with.

We need to cultivate the art of plainspokenness - saying exactly what you mean; and along with that comes accountability.

This is a good argument for a carbon tax, which even most conservative economists support. There is no constitutional argument against this as Congress has the power to tax as do states.

Heck, make it a 7-6 flaming liberal court. Why be moderate when they sure won’t be? Not one of the R appointees since Thomas is remotely “moderate.”

The Green Party seems to be working to get Trump elected just like they got Lil Bush elected over Gore. The Green Party has turned anti environment. Jill Stein should be ashamed of herself.
Anyone voting for the Green Party candidate is voting for Trump.

The Supreme Court has ruled that carbon dioxide can be regulated as a pollutant.

I hope somebody asks Trump’s nominee about that. (Although, on the other hand, it might be best if the Democrats boycott the whole thing because whatever the nominee says doesn’t matter.

The nominee will be thoroughly coached… And maybe that’s a good first question: “what preparations did you make for this hearing, and with whom did you consult?” Then sit back and listen and ask follow-ups. See if they’ll spill.)

The real question is what will the Supreme Court do when global warming soon makes it impossible for human beings to survive.

Given the runaway rate of warming, it is likely the Court will face this challenge within about 10-25 yeas time. The problem, of course, will be that no decision will prevent it from happening as food resources are already at risk.

What is the most depressing is that Bush 1 replaced Thurgood Marshall with Clarence Thomas and now Trump proposed the replacement for RBG with this woman.
